Saikospeed Community Privacy Policy

This Privacy Policy explains how Happy Racer LLC, doing business as Saikospeed and Saikospeed Community ("Saikospeed," "we," "us," or "our"), collects, uses, stores, discloses, and protects information when you access or use community.saikospeed.com, related community features, user profiles, garage pages, photo uploads, interactive vehicle build tools, messaging, comments, AI features, rewards, events, and other online services that link to this Privacy Policy.

By using Saikospeed Community, you acknowledge that you have read and understood this Privacy Policy. This Privacy Policy is incorporated by reference into our Terms and Conditions.

1. Important Notice About Public Community Content

Saikospeed Community is a social and public-facing automotive community platform. Some areas of the Services are public by design. Public profiles, public garage pages, public vehicle photos, build details, parts lists, hotspots, captions, posts, comments, likes, follows, community activity, usernames, and display names may be visible to other users, visitors, search engines, automated bots, and third parties.

Public content may include, without limitation:

  • Your username, display name, profile photo, bio, location, and social links.
  • Garage profiles, vehicle information, build details, parts lists, captions, comments, posts, likes, follows, community memberships, and other interactions.
  • Photos, images, videos, thumbnails, hotspots, product tags, and other uploaded assets.
  • Vehicle details, license plates, faces, locations, garage backgrounds, shop interiors, addresses, or other information visible in uploaded photos.

You should not upload or post anything you do not want others to see, save, copy, screenshot, download, share, repost, index, archive, or associate with you.

Visibility settings are intended to control how content appears within the Services, but they do not guarantee complete removal from the internet. Public content may be copied, screenshotted, indexed, archived, embedded, cached, reposted, downloaded, or otherwise preserved by third parties outside our control.

If you change content from public to private, delete content, or delete your account, we may still retain copies where reasonably necessary for backups, legal compliance, security, fraud prevention, dispute resolution, moderation, enforcement of our Terms, internal records, or legitimate business purposes.

2. Notice at Collection

Saikospeed Community may collect account information, profile information, uploaded photos and media, garage/build details, parts lists, product links, community activity, device information, cookies, usage data, and related information to operate the community, provide public profiles and garage pages, authenticate users, store and display uploads, personalize content, moderate abuse, improve the platform, provide support, verify purchases, provide rewards, operate AI features, and market Saikospeed products and services.

Public content may be visible to anyone and may be used for promotional purposes as described in our Terms and this Privacy Policy. Do not upload private, sensitive, or third-party information unless you have permission.

3. Information We Collect

We may collect the following categories of information.

A. Account and Identity Information

When you create an account, sign in, or manage your profile, we may collect:

  • Username.
  • Display name.
  • Email address.
  • Profile image.
  • Bio.
  • General location if you provide it.
  • Social media handles or links.
  • Authentication identifiers from our identity provider.
  • Account role, account status, and account settings.
  • Login, logout, session, and security information.

We may use third-party identity infrastructure, such as AWS Cognito or another authentication provider, to help manage sign-up, sign-in, and authentication. We do not need to receive or store your password if authentication is handled by the identity provider.

B. Community Profile and Garage Content

We collect information you submit, upload, or create through the platform, including:

  • Garage names and nicknames.
  • Vehicle year, make, model, trim, engine, transmission, drivetrain, body style, color, build status, and related metadata.
  • Vehicle photos and other uploaded media.
  • Captions, notes, and descriptions.
  • Parts lists, brands, SKUs, installation status, product links, and custom parts.
  • Interactive photo hotspots, pointer coordinates, labels, notes, and linked products.
  • Posts, build updates, comments, likes, follows, reactions, community memberships, chat messages, and other social activity.
  • Event participation, rewards, referrals, affiliate activity, and promotional participation if those features are enabled.

C. Uploaded Photos, Videos, and Other Media

When you upload photos, videos, images, or other files, we collect and store the uploaded asset and associated metadata needed to operate the platform. Uploaded assets may be stored by us or by our service providers, including cloud hosting, CDN, database, file storage, image processing, moderation, backup, and security providers.

Uploaded photos, videos, and other media may contain personal information, including faces, license plates, addresses, GPS metadata, garage interiors, vehicle identification details, shop locations, or other identifiable information. You are responsible for reviewing your media before uploading it and for blurring or removing information you do not want shared.

We may process uploaded media to host, store, resize, crop, compress, optimize, moderate, secure, analyze, display, back up, and improve the Services. Our personnel, contractors, service providers, automated systems, and moderation tools may access uploaded media for these purposes.

Unless otherwise stated, we do not intentionally create biometric identifiers or biometric templates from user-uploaded photos or videos. If we later introduce features that use facial recognition, face geometry, voiceprints, augmented reality filters, identity verification, automated plate recognition, or similar technologies that may be regulated as biometric information, we may provide additional notice, consent options, retention terms, or opt-out rights where required by law.

You are responsible for ensuring that you have the rights, permissions, and consents necessary to upload any content, including content that contains other people, license plates, private property, shop interiors, addresses, or other personal information.

D. Store, Purchase, Rewards, and Membership Information

If we connect Saikospeed Community to Saikospeed store accounts, Shopify, order history, membership programs, rewards, discounts, affiliate programs, or product verification features, we may collect or receive:

  • Customer account identifiers.
  • Purchase history.
  • Product SKUs, order status, and product ownership information.
  • Verified-purchase status.
  • Membership status, store credit, reward points, redemptions, coupon codes, referrals, or affiliate activity.
  • Customer support, warranty, fitment, and product inquiry information.

We may use this information to verify purchases, unlock community badges, personalize product recommendations, issue rewards, prevent fraud, provide support, and operate Saikospeed-related services.

E. Communications and Support

If you contact us, we may collect:

  • Your name, email address, phone number, order information, and message content.
  • Attachments, screenshots, photos, or files you send.
  • Support history, internal notes, and resolution records.
  • Communications through email, forms, chat, social media, or other channels.

F. Private Messages and Communications

If direct messages, private chats, group chats, support messages, or similar communication features are enabled, we may process those communications to deliver the messages, maintain conversation history, provide notifications, detect spam or abuse, investigate violations, comply with law, provide support, improve reliability, and protect users and the Services.

Private messages are not guaranteed to be end-to-end encrypted unless we expressly state that a specific feature is end-to-end encrypted. We and our service providers may be able to access message content when necessary for operation, moderation, safety, legal compliance, debugging, or support.

Do not send passwords, payment card numbers, government IDs, confidential business information, trade secrets, sensitive personal information, or information about other people through the Services unless the feature specifically requests it and you are authorized to provide it.

G. Device, Usage, Log, and Technical Information

When you use the Services, we may automatically collect:

  • IP address.
  • Device type.
  • Browser type.
  • Operating system.
  • Referring URL.
  • Pages viewed.
  • Search queries.
  • Clicks, interactions, scrolls, session events, and feature usage.
  • Date and time of access.
  • Approximate location derived from IP address.
  • Cookies, pixels, tags, local storage identifiers, session identifiers, and similar technologies.
  • Error logs, crash reports, security logs, and performance data.

Browsing the Services without signing in does not mean your activity is anonymous to us. We may still collect device information, IP address, cookies, logs, approximate location, analytics events, security data, and other technical information from visitors who are not signed in.

H. Analytics, Advertising, and Inferences

We may collect or create information about your preferences and interests, such as:

  • Vehicle interests.
  • Product interests.
  • Build style preferences.
  • Communities visited.
  • Content you interact with.
  • Likely fitment, modification, or product preferences.
  • Advertising or campaign attribution data.

If we use advertising, retargeting, analytics pixels, or similar technologies, those partners may collect information from your device or browser according to their own policies and our agreements with them.

I. AI Feature Data

If we offer AI-assisted features, we may collect and process:

  • Prompts, questions, uploaded files, images, or other inputs you provide to AI tools.
  • AI-generated outputs.
  • Feedback, ratings, corrections, and interaction history.
  • Community content used to power search, recommendations, moderation, summaries, image analysis, product matching, fitment assistance, or support tools.

AI features may process public content, profile content, garage content, uploaded assets, product information, usage signals, and other information you provide or generate through the Services.

J. Sensitive Personal Information

We do not intentionally require sensitive personal information to operate Saikospeed Community. However, sensitive information may appear in content you choose to upload or submit, such as photos, messages, location details, or personal circumstances included in a post.

Please do not upload sensitive personal information unless necessary. We may process such information only as needed to provide the Services, secure the Services, moderate content, comply with law, protect rights, or enforce our Terms.

4. How We Use Information

We may use information for the following purposes:

  • To operate, provide, maintain, and improve Saikospeed Community.
  • To create and manage user accounts, sessions, authentication, and security.
  • To display public profiles, public garage pages, builds, posts, comments, hotspots, product links, and community activity.
  • To store, host, resize, optimize, display, and deliver uploaded media.
  • To enable interactive features, including garage pages, photo hotspots, product tags, build pages, comments, likes, follows, communities, chat, events, and rewards.
  • To personalize content, recommendations, feeds, product suggestions, communities, and user experience.
  • To verify purchases, issue badges, rewards, store credit, discounts, or other benefits.
  • To provide customer support and respond to inquiries.
  • To send service messages, security notices, account updates, policy updates, and administrative communications.
  • To send marketing communications where permitted by law.
  • To analyze usage, debug errors, test features, measure performance, and improve the Services.
  • To detect, investigate, prevent, and respond to fraud, spam, scraping, abuse, malware, security incidents, unauthorized access, policy violations, or illegal activity.
  • To moderate content, enforce our Terms, and protect users, Saikospeed, Happy Racer LLC, and the public.
  • To operate AI-assisted features, moderation tools, search tools, product matching, recommendations, support tools, and safety systems.
  • To comply with legal obligations, law enforcement requests, court orders, subpoenas, regulatory requirements, and contractual obligations.
  • To protect our rights, property, business, users, employees, contractors, vendors, and partners.
  • To evaluate or complete a merger, acquisition, financing, sale, reorganization, bankruptcy, or transfer of assets.

5. Public Content and Promotional Use

Content you post publicly on Saikospeed Community may be displayed publicly on the Services and may also be used by us for promotional, marketing, advertising, social media, email, website, product, community, and brand-related purposes, subject to our Terms and Conditions.

This may include public garage photos, build images, usernames, vehicle information, captions, posts, comments, product tags, parts lists, and related public content.

Public content you upload or post may be used by us for promotional, marketing, advertising, social media, website, email, product, community, and brand-related purposes, subject to the license you grant in our Terms and Conditions.

We do not intend to use private direct messages or private account content in public marketing materials without consent, except to the extent content was previously public, de-identified, aggregated, or otherwise permitted by law and our Terms.

The specific license you grant us to use user-generated content should be stated in the Terms and Conditions. This Privacy Policy explains how we collect and process that content; it does not replace the content license in the Terms.

6. How We Disclose Information

We may disclose information as described below.

A. Public Disclosure

Public profile information, public garage pages, public photos, public posts, public comments, public likes, public follows, public community activity, product tags, and other public content may be visible to anyone.

B. Other Users

We disclose information to other users as necessary to operate social features, including profiles, builds, comments, likes, follows, messages, communities, events, leaderboards, rewards, badges, and other interactive features.

C. Service Providers and Vendors

We may disclose information to vendors and service providers that perform services for us, such as:

  • Hosting and infrastructure providers.
  • Database providers.
  • File storage and CDN providers.
  • Authentication providers.
  • Email and communication providers.
  • Analytics providers.
  • Error logging and performance monitoring providers.
  • Payment, ecommerce, Shopify, order, reward, or membership providers.
  • AI providers and model infrastructure providers.
  • Content moderation and safety providers.
  • Security, fraud prevention, and abuse detection providers.
  • Customer support and ticketing providers.
  • Marketing, advertising, and attribution providers.
  • Professional advisors, including lawyers, accountants, auditors, consultants, and insurers.

D. Saikospeed, Happy Racer LLC, and Related Brands

We may disclose information between Happy Racer LLC, Saikospeed, Saikospeed Community, related brands, websites, stores, systems, personnel, contractors, and service providers for business, operational, customer support, security, analytics, marketing, legal, and administrative purposes.

E. Advertising and Analytics Partners

If we use advertising pixels, retargeting, analytics cookies, conversion tracking, or similar technologies, we may disclose device, usage, and interaction information to advertising and analytics partners.

This may be considered a "sale," "sharing," or "targeted advertising" under certain privacy laws, even if we do not sell personal information for money. Where required, we will provide opt-out rights.

F. Third-Party Integrations, Vendors, and APIs

The Services may integrate with third-party services, including authentication providers, ecommerce platforms, payment providers, shipping providers, analytics providers, advertising partners, AI providers, cloud infrastructure, file storage, CDNs, customer support tools, moderation vendors, email providers, and social platforms.

These providers may process information on our behalf or according to their own terms and privacy policies, depending on the integration. We are not responsible for third-party services that you choose to connect, visit, or use outside the Services.

We may also use APIs, service providers, and internal systems to connect Saikospeed Community with Saikospeed store accounts, purchase history, rewards, memberships, verified-purchase status, product recommendations, fitment features, and customer support.

G. Legal, Safety, and Enforcement

We may disclose information if we believe it is reasonably necessary to:

  • Comply with law, regulation, legal process, subpoena, court order, or government request.
  • Enforce our Terms, policies, agreements, and rights.
  • Investigate fraud, abuse, security incidents, or unlawful activity.
  • Protect the rights, safety, and property of Saikospeed, Happy Racer LLC, users, customers, employees, contractors, vendors, partners, or the public.
  • Defend against legal claims.

H. Business Transfers

7. Cookies, Tracking, and Similar Technologies

We may use cookies, pixels, SDKs, tags, local storage, session identifiers, analytics tools, advertising technologies, conversion tracking, and similar technologies to operate the Services, keep users signed in, secure accounts, prevent fraud, remember preferences, measure performance, debug errors, understand usage, personalize content, measure advertising, and market Saikospeed products and services.

Some tracking technologies may collect information even if you are not signed in, including IP address, browser type, device information, referring page, pages viewed, approximate location, interactions, and timestamps.

If we use cross-context behavioral advertising, retargeting, or certain analytics/advertising technologies, those activities may be considered a "sale," "sharing," or "targeted advertising" under certain privacy laws, even if we do not sell personal information for money. Where required, we will provide the ability to opt out.

Where legally required, we will honor recognized opt-out preference signals, such as Global Privacy Control, for applicable browsers, devices, or regions.

We may not respond to browser "Do Not Track" signals because there is no uniform industry standard. However, where required by law, we will honor legally recognized opt-out preference signals, such as Global Privacy Control, for applicable opt-out rights.

Blocking cookies may affect sign-in, account features, community functionality, and security features.

8. Contact Import, Referrals, and Invites

If we offer contact-import, referral, affiliate, friend-finder, garage-invite, or similar features, we may ask for permission to access contact information or allow you to provide contact details manually. We will use that information to provide the requested feature, such as sending an invitation, referral link, or notification.

You should only provide contact information for people you are authorized to contact. We may limit the number or frequency of invitations and may provide unsubscribe or opt-out mechanisms where appropriate.

We will not intentionally send repeated promotional invitations to your contacts without your direction or authorization.

9. Your Choices and Privacy Controls

Depending on your location and applicable law, you may have some or all of the following choices:

  • Access, update, or correct your account information.
  • Edit or delete certain profile, garage, photo, post, comment, or community content.
  • Change visibility settings where available.
  • Opt out of marketing emails by using the unsubscribe link or contacting us.
  • Control cookies through your browser or device settings.
  • Opt out of certain advertising or tracking technologies where available.
  • Request access to personal information we hold about you.
  • Request deletion of personal information.
  • Request correction of inaccurate personal information.
  • Request a copy of personal information in a portable format.
  • Opt out of sale, sharing, targeted advertising, or certain profiling where required by law.
  • Limit certain uses of sensitive personal information where required by law.
  • Appeal a denied privacy request where required by law.

Privacy settings, visibility settings, account settings, opt-outs, and deletion tools are designed to give users choices, but they may not affect information already processed, copied, shared, backed up, cached, indexed, or retained for legal, security, moderation, or operational purposes.

We do not sell personal information for money.

If we use advertising, retargeting, analytics pixels, or cross-context behavioral advertising technologies, certain disclosures may be considered "selling" or "sharing" under California law. California residents may opt out by contacting us or using any opt-out mechanism we provide.

We do not knowingly sell or share personal information of consumers under 16.

Saikospeed Community is operated from the United States. If you access the Services from outside the United States, your information may be transferred to, stored in, and processed in the United States and other countries where we or our service providers operate.

Where required by applicable law, we rely on appropriate legal bases to process personal information, including:

12. AI Features and Automated Processing

We may use artificial intelligence, machine learning, computer vision, automated classification, recommendation systems, and similar technologies to operate, improve, secure, moderate, and personalize the Services.

AI features may be used for purposes such as content moderation, spam detection, abuse prevention, image review, vehicle or parts recognition, product matching, fitment assistance, search, recommendations, summaries, customer support, caption assistance, and community safety.

Depending on the feature, AI systems may process profile information, public garage content, uploaded images, product information, posts, comments, messages, support requests, usage signals, and other information you provide or generate through the Services.

We may use third-party AI providers or infrastructure providers to operate AI features. When we do so, information may be transmitted to those providers as necessary to provide the feature, subject to our agreements with them.

We will not intentionally use the contents of private direct messages to train third-party generative AI models unless we provide additional notice or obtain consent where required by law. Public content, de-identified data, aggregated data, feedback, and usage data may be used to improve, test, evaluate, or develop our Services, including AI-enabled features, where permitted by law.

AI outputs may be inaccurate, incomplete, outdated, biased, offensive, unsafe, or inappropriate. AI outputs are not professional advice. Do not rely on AI features for vehicle safety, installation, tuning, racing, mechanical, electrical, legal, financial, medical, or emergency decisions.

Do not submit sensitive personal information, confidential information, trade secrets, payment information, government identification, medical information, or information about other people into AI features unless the feature specifically requests it and you are authorized to provide it.

We may review, modify, reject, remove, restrict, suspend, or act on content or accounts based on automated and human review.

13. Data Retention

We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, including:

  • Providing the Services.
  • Maintaining accounts.
  • Hosting community content.
  • Completing transactions.
  • Providing customer support.
  • Enforcing our Terms.
  • Preventing fraud or abuse.
  • Maintaining security.
  • Complying with legal obligations.
  • Resolving disputes.
  • Keeping business records.
  • Maintaining backups.

Public content may remain available until deleted, removed, or made private, subject to technical limitations. Deleted information may remain in backups, logs, caches, archives, legal holds, moderation records, or other systems for a limited period or as required by law.

Deleting content or an account may not immediately remove all copies of information. We may retain information in backups, logs, archives, moderation records, legal records, fraud-prevention systems, analytics records, customer support records, transaction records, or other systems where reasonably necessary.

Public content may continue to appear in search engines, third-party caches, screenshots, reposts, embeds, or archives outside our control. We are not responsible for removing copies from third-party systems.

We may retain aggregated, de-identified, or anonymized information indefinitely.

14. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. These may include access controls, authentication, secure cookies, encryption where appropriate, logging, monitoring, file validation, moderation tools, and vendor security measures.

No website, app, network, database, or storage system is 100% secure. We cannot guarantee absolute security. You are responsible for keeping your account credentials secure and for promptly notifying us of any unauthorized access or suspected security issue.

15. Children and Minors

The Services are not directed to children under 13, and users under 13 are not permitted to create accounts or use the Services. We do not knowingly collect personal information from children under 13.

If you are under 13, do not use the Services or submit any personal information.

If we learn that we have collected personal information from a child under 13 without legally valid parental consent, we will take reasonable steps to delete the information and terminate or restrict the account.

Parents or legal guardians who believe a child under 13 has provided information to us may contact us at support@saikospeed.com to request deletion.

If you are under the age of majority in your jurisdiction, you should use the Services only with permission from a parent or legal guardian.

If we later offer features directed to minors, teen users, school groups, youth motorsports, or similar audiences, we may provide additional notices, parental controls, age gates, consent flows, or restrictions as required by law.

16. Third-Party Links and Services

The Services may link to or integrate with third-party websites, stores, apps, services, platforms, social networks, payment processors, shipping providers, product pages, analytics providers, advertising partners, AI providers, or ecommerce systems.

We are not responsible for the privacy practices, content, security, or policies of third parties. Your use of third-party services is governed by their own terms and privacy policies.

17. User Responsibilities

You are responsible for the content and information you provide. Do not upload or submit:

  • Content you do not have the right to share.
  • Private information about other people without permission.
  • Sensitive personal information unless necessary.
  • Payment card numbers, passwords, government IDs, or confidential information.
  • Content that violates our Terms, laws, or third-party rights.

You should blur or remove license plates, faces, addresses, documents, GPS metadata, or other identifying information if you do not want them visible.

18. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The "Last Updated" date above indicates when this Privacy Policy was last revised.

If we make material changes, we may provide notice through the Services, by email, or by other reasonable means. Your continued use of the Services after an updated Privacy Policy becomes effective means you acknowledge the updated policy.
